These Terms of Service (the “Terms”) govern your access to and use of the Wandly platform, website at wandly.io and related services (the “Service”), operated by Allowed Limited (business registration number 77573808) (“Wandly”, “we”, “us”). By creating an account or using the Service you agree to these Terms.

1. The Service

Wandly is an interactive platform for live events, tours, lectures and presentations. A host broadcasts slides, an in-browser audio guide, quizzes and reactions to guests’ own devices via a link or QR code, and can collect reviews, contacts and tips. Guests join without installing an app.

2. Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to create a host account. You are responsible for the accuracy of your account information, for keeping your login secure, and for all activity under your account. Guests may join events without an account.

3. Acceptable use

You agree not to use the Service to:

upload or share unlawful, infringing, hateful or harmful content;
violate the intellectual-property or privacy rights of others;
collect personal data of guests without a lawful basis and appropriate notice;
disrupt, overload, reverse-engineer or attempt to gain unauthorised access to the Service.

As a host you are the controller of any personal data you collect from your guests (names, emails, phone numbers) and are responsible for having a lawful basis and providing your guests with appropriate privacy information. Wandly acts as your processor for that data.

4. Subscriptions and billing

Paid plans are billed in advance on a recurring basis (monthly or yearly) through our payment processor, Stripe. Prices are shown on our pricing page and are exclusive of any applicable taxes unless stated otherwise. Your subscription renews automatically until cancelled; you may cancel at any time and retain access until the end of the paid period. Except where required by law, payments are non-refundable.

5. Tips

Where a host enables tips, guests may choose to tip the host. Tips are a voluntary payment from the guest to the host and are processed by the host’s chosen payment provider. Wandly is not a party to tips, does not hold tip funds, and charges no commission on them.

6. Content and intellectual property

You retain all rights to the content you upload (“Host Content”). You grant Wandly a limited, worldwide, non-exclusive licence to host, process and display Host Content solely to provide the Service. The Service itself, including its software, design and trademarks, is and remains the property of Wandly.

7. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.

8. Limitation of liability

To the maximum extent permitted by law, Wandly’s total liability arising out of or relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect, incidental or consequential damages, or for lost profits or data. Nothing in these Terms limits liability that cannot be limited by law.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or use the Service unlawfully. Provisions that by their nature should survive termination will survive.

10. Governing law

These Terms are governed by the laws of the jurisdiction in which Allowed Limited is registered, without regard to conflict-of-laws rules. If you are a consumer, you also benefit from the mandatory protections of the law of your country of residence.

11. Changes

We may update these Terms from time to time. Material changes will be notified via the Service or by email; continued use after changes take effect constitutes acceptance.
